TERMS OF SERVICE AND LIABILITY WAIVER
PLEASE READ THIS DOCUMENT CAREFULLY. BY CLICKING “I AGREE,” MAKING A BOOKING, OR USING THE WILLARD BAY SAUNA FACILITIES OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
1. DEFINITIONS
"Willard Bay Sauna" refers to State Park Saunas LLC d/b/a Willard Bay Sauna, its owners, officers, operators, employees, contractors, agents, affiliates, successors, and assigns.
"Services" refers to the use of any sauna facilities, cold plunge equipment, access systems, changing areas, or related amenities provided by Willard Bay Sauna.
"User," "you," or "your" refers to any individual who uses or attempts to use the Services.
"Allotted Time" means the exact duration specified during the booking process, which includes all time spent preparing to use the facility, using the sauna or cold plunge, using any changing facilities, and vacating the premises.
2. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS
You acknowledge that use of sauna, cold plunge, and related facilities involves inherent and significant risks, including but not limited to:
• Overheating, dehydration, or heat exhaustion
• Dizziness, nausea, fainting, or loss of consciousness
• Cardiovascular stress, heart attack, or stroke
• Burns from hot surfaces, steam, or equipment
• Slips, trips, and falls
• Risks associated with cold water immersion, including cold shock response, hypothermia, cardiac arrhythmia, and loss of motor control
• Aggravation of pre-existing medical conditions
• Serious injury or death
You voluntarily, knowingly, and expressly assume all such risks, whether known or unknown, foreseeable or unforeseeable, including those arising from ordinary negligence by Willard Bay Sauna or its agents.
3. HEALTH AND MEDICAL RESPONSIBILITY
We strongly recommend that you consult a licensed physician before using the Services if you have any health concerns. You affirm that you are physically able to use the Services and assume full responsibility for determining your fitness to participate.
You agree not to use the Services if you have any condition that may make sauna or cold plunge use unsafe, including but not limited to:
a) Cardiovascular conditions, including hypertension, hypotension, heart disease, or history of heart attack
b) Respiratory disorders, including asthma or COPD
c) Pregnancy
d) Epilepsy or history of seizures
e) Diabetes
f) Recent surgery or open wounds
g) Skin conditions or sensitivities
h) History of heat-related illness
i) Any condition that may be aggravated by heat or cold exposure
You agree to immediately discontinue use if you experience discomfort, dizziness, or unusual symptoms, and to seek medical attention if needed.
Willard Bay Sauna does not provide medical supervision or medical advice.
4. PROPER USE OF FACILITIES
You agree to follow all posted rules and safety guidance. Without limitation:
• Limit sauna sessions to a maximum of 20 minutes at a time (we recommend 5–15 minutes)
• Remain hydrated before, during, and after use
• Do not use alcohol or drugs before or during use
• Do not sleep in the sauna
• Exit immediately if feeling unwell
• Gently drizzle — do not dump — only the provided sauna water onto the hot rocks
• Do not touch heating elements or tamper with equipment
• Use a towel on sauna benches; do not wear street clothes or shoes in the sauna
• Do not use oils, lotions, or other substances in the sauna without prior approval
• Wash feet in the provided bucket before entering the sauna
• Complete all changing within your booked time slot
• Do not use the cold plunge alone; do not submerge your head; exit immediately if you feel faint or short of breath
Failure to comply may result in removal without refund.
5. CONDUCT AND ETIQUETTE
Disruptive, unsafe, or inappropriate behavior is prohibited. This includes but is not limited to: disruptive verbal or non-verbal behavior; intimate physical contact; nudity; intoxication; and any conduct that may damage the reputation of the facility. Willard Bay Sauna reserves the right to refuse access or remove any individual for safety, policy violations, or operational reasons, with no refund issued.
Children under the age of 16 are not permitted to use the Services under any circumstances.
Any hanging jewelry should be removed before entering the sauna to prevent burning.
6. GROUP BOOKING LIABILITY
If you make a reservation for or permit entry to any additional participant, you represent and warrant that: (a) you have the full legal authority to agree to these Terms on their behalf; (b) each such participant meets all health and age eligibility requirements set forth herein; (c) you have informed each participant of all rules, risks, and terms contained in this Agreement; and (d) each such participant has agreed to be bound by this Agreement.
You accept full responsibility for the conduct and safety of all participants admitted under your reservation while on the premises. You remain financially responsible for all charges, overstays, and penalties incurred by any participant under your booking.
You agree to indemnify, defend, and hold harmless Willard Bay Sauna from any claims, demands, damages, or expenses (including attorney fees) arising from or related to the participation, actions, injuries, or property damage caused by any individual admitted under your reservation.
You acknowledge that individuals under the age of 16 are not permitted under any reservation. Nothing in this Agreement attempts to waive the independent legal rights of any other adult or minor.
7. ACCESS AND LOCKOUT POLICY
You are solely responsible for safeguarding your access credentials, arriving within your scheduled time, and ensuring proper operation of the access system during your session.
To the fullest extent permitted by law, Willard Bay Sauna is not responsible for losses resulting from forgotten codes or credentials, device or connectivity failures, power or equipment interruptions, weather conditions, or any other circumstance resulting in inability to access the facilities.
No refunds, credits, or compensation are provided for session time lost due to lockout, regardless of cause or duration. In case of lockout, you agree not to attempt to force entry or tamper with any equipment.
8. SESSION DURATION AND OVERSTAYS
Your reservation covers all time spent preparing, using the facilities, and vacating the premises. Remaining beyond your Allotted Time without prior written approval constitutes an “Overstay” and automatically authorizes Willard Bay Sauna to charge your payment method for additional session(s) at the then-current standard rate. Charges apply to both full and partial additional sessions.
Payment for Overstay time does not guarantee continued exclusive use. Willard Bay Sauna reserves the right to limit access, reassign the space, and take any necessary actions to maintain scheduling. Repeated or excessive Overstays may result in suspension or termination of booking privileges.
You are solely responsible for monitoring your usage time. This policy applies regardless of facility occupancy, time of day, season, weather, or any other circumstance not explicitly excused in writing.
9. PROPERTY DAMAGE
You assume full responsibility for any damage to the sauna structure, heating equipment, electronics and control systems, door and locking mechanisms, changing facilities, surrounding grounds, and any other Willard Bay Sauna property or equipment. Your liability extends to damage caused by your direct actions or negligence, members of your party, and unauthorized guests you allow access.
You explicitly authorize Willard Bay Sauna to charge your payment method on file for repair or replacement costs, reasonable administrative fees related to damage resolution, lost revenue during repair periods, and to pursue legal action to recover damages exceeding card limits.
Willard Bay Sauna’s documentation of damage — including security camera footage, staff reports, contractor assessments, and photographic evidence — may be relied upon as evidence of damage and its cause for purposes of determining liability.
10. ENVIRONMENTAL AND EXTERIOR CONDITIONS
You acknowledge that the operation of the sauna facility may create or contribute to hazardous exterior conditions, including but not limited to:
• Wet or icy surfaces resulting from water runoff, condensation, or weather conditions
• Ice formation from water runoff from bucket showers and other sauna features
• Wet, uneven, or otherwise hazardous walking surfaces surrounding the facility
You understand that despite reasonable maintenance efforts, environmental factors such as freezing temperatures can cause ice to form on surfaces around the sauna. You expressly assume all risks associated with such conditions, including any combination of natural weather conditions and sauna-operation effects.
You agree to exercise heightened caution on exterior surfaces, wear appropriate footwear, use provided walkways and designated paths, and report hazardous conditions immediately. You acknowledge that immediate removal of ice or treatment of slippery conditions may not always be possible and that surface conditions may change during your session.
You specifically release Willard Bay Sauna from any claims arising from slip and fall incidents on exterior surfaces, injuries related to ice formation from sauna operations, and any incident involving exterior surface conditions.
11. CANCELLATION AND BOOKING POLICY
Cancellations or modifications must be made no less than twelve (12) hours prior to the scheduled start of your Appointment. The 12-hour period is calculated backwards from the Appointment’s scheduled start time.
Any cancellation or modification request made within 12 hours of the scheduled Appointment time is not permitted. Prohibited actions include requesting a refund, changing the Appointment time, altering the number of participants, transferring the Appointment to another party, or any other substantial change to the original booking.
Cancellations made outside the 12-hour window will receive a credit toward a future session. No cash refunds will be issued under any circumstances.
The Company may, at its sole discretion, waive this policy in cases of provable emergency, natural disaster, or other unforeseeable circumstances beyond the Customer’s control. The burden of proof for such circumstances rests solely with the Customer.
By booking, you accept full financial responsibility for your reservation. If you believe you are entitled to a credit under this policy, you agree to contact us first and allow a reasonable time to resolve the matter before pursuing any other remedy. You agree not to initiate a chargeback except in cases of fraud or as otherwise required by law.
12. UNAUTHORIZED ACCESS / THEFT OF SERVICES
This section applies to individuals who access the facility without any valid booking. It does not apply to guests properly included in a group reservation under Section 6 of this Agreement.
A participant is “properly included” in a reservation only if: (a) the booking explicitly states the number of participants attending, and (b) the booking fee covering that number of participants has been paid in full prior to the session. Any individual present at the facility beyond the declared and paid-for headcount is an unauthorized guest subject to the penalties below.
Only properly booked individuals may use the Services. Permitting or facilitating unauthorized access authorizes Willard Bay Sauna to charge your payment method for the unpaid session(s) plus the following theft-of-services penalties:
• 1 unauthorized guest — Session price ($36) + $50 penalty
• 2 unauthorized guests — Session price for both + $100 penalty
• 3 unauthorized guests — Session price for all three + $200 penalty
• 4 unauthorized guests — Session price for all four + $300 penalty
• 5 or more unauthorized guests — Session price for all + $500 minimum penalty (with additional penalties at the Company’s discretion)
Willard Bay Sauna may additionally suspend or permanently terminate your booking privileges, report the violation to Utah State Parks management and/or law enforcement, and pursue civil remedies to recover damages, administrative costs, and attorney’s fees.
Unauthorized access may be detected and documented by electronic access logs, security camera footage, staff, or park personnel. You expressly agree that such documentation may be relied upon as evidence for purposes of determining liability.
13. RELEASE OF LIABILITY
To the fullest extent permitted by Utah law, you hereby release, waive, discharge, and covenant not to sue Willard Bay Sauna from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you or to any property belonging to you, while using the Services or while on or upon the premises. This release includes claims arising from ordinary negligence by Willard Bay Sauna.
This release does not apply to claims arising from gross negligence or willful misconduct where prohibited by law.
14. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Willard Bay Sauna from any and all claims, suits, actions, liabilities, losses, costs, damages, judgments, and expenses (including attorney fees) arising from or related to:
j) Your use of the Services
k) Any violation of this Agreement
l) Actions or conduct of persons admitted to the facility under your reservation
m) Any misrepresentation you make regarding eligibility, health status, or agreement to these Terms
15. PROPERTY LOSS
You are solely responsible for personal property. Willard Bay Sauna is not liable for any loss or damage to personal belongings while using the Services.
16. SURVEILLANCE, PHOTO, AND VIDEO RELEASE
You acknowledge that the facility is monitored by security cameras for safety and operational purposes, and you consent to such monitoring. You additionally grant Willard Bay Sauna the irrevocable, royalty-free right to use your likeness, image, voice, or appearance as captured in any photos, videos, or recordings taken while using the Services for any lawful business purpose, including marketing, social media, and promotional materials.
17. NO WARRANTIES
Services are provided “as is” and “as available” without warranties of any kind, express or implied. Willard Bay Sauna expressly disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Willard Bay Sauna shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, including but not limited to lost profits or data loss, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages. Personal injury claims are governed exclusively by the Release of Liability in Section 13.
19. GOVERNING LAW AND JURISDICTION
This Agreement is governed by the laws of the State of Utah. Any disputes shall be resolved exclusively in the state or federal courts located in Utah, and you hereby consent and submit to the personal jurisdiction of such courts.
20. SEVERABILITY
If any provision of this Agreement is held to be unenforceable or invalid, such provision shall be modified to the minimum extent necessary to make it enforceable and valid, and the remaining provisions shall remain in full force and effect.
21. KNOWING AND VOLUNTARY AGREEMENT
You acknowledge that you have had the opportunity to review this Agreement in full, that you understand its contents, and that you are entering into it knowingly and voluntarily. You further acknowledge that this Agreement is a material condition of your access to the Services and that Willard Bay Sauna would not permit access without your agreement to these terms.
22. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between you and Willard Bay Sauna regarding the use of the Services and supersedes all prior agreements and understandings, whether written or oral.
BY CLICKING “I AGREE” OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT AND VOLUNTARILY GIVE UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE WILLARD BAY SAUNA.
